Terms of Service

The agreement, in plain words.

These terms set out the deal between you and Useful Made when you use our website, apps, and products. We have kept them short and readable — but they are a binding agreement, so please read them.

01   Acceptance

By using our website, downloading an app, or otherwise accessing a Useful Made product, you agree to these terms.

These terms are an agreement between you and Useful Made, an independent software company (“Useful Made”, “we”, “us”), covering our website, our applications including Wavebender, and any related services — together, the “Services”. If you do not agree with them, please do not use the Services. If you are using the Services on behalf of an organisation, you confirm you are authorised to accept these terms for it.

02   Eligibility

You must be old enough to form a binding contract where you live — generally at least 13, and older where your country requires it. If you are under the age of majority, you may use the Services only with the involvement of a parent or guardian who agrees to these terms. By using the Services, you confirm you meet these requirements and that any information you give us is accurate.

03   The Services

We build our own software and offer it to you to use. We may add, change, or remove features, and we may update, suspend, or discontinue a product or the Services as a whole. Where a change materially reduces a paid feature you rely on, we will give reasonable notice. We are always working to keep the Services running well, but we provide them on an ongoing, evolving basis rather than as a fixed, guaranteed set of features.

04   Your licence to use

Subject to these terms, we grant you a personal, limited, non‑exclusive, non‑transferable, revocable licence to use the Services and install our apps on devices you own or control, for your own lawful use. This is a licence, not a sale — we and our licensors keep all rights not expressly granted to you. Apps obtained through an app store are also subject to that store’s rules.

05   Acceptable use

We ask you to use the Services fairly and lawfully. You agree not to:

  • Break the law, infringe others’ rights, or use the Services to harm, harass, or deceive anyone.
  • Copy, modify, reverse‑engineer, decompile, or create derivative works from the Services, except where the law expressly allows it.
  • Resell, rent, sublicense, or commercially redistribute the Services without our written permission.
  • Interfere with, overload, or attempt to gain unauthorised access to the Services, our systems, or other users’ data.
  • Remove or obscure any notices, or misrepresent your affiliation with Useful Made.

We may suspend or end your access if you break these rules or put the Services or other people at risk.

06   Purchases & subscriptions

Some products or features may be paid, one‑time or by subscription. Prices are shown before you buy. Purchases made through an app store are billed and managed by that store, and its refund, renewal, and cancellation rules apply — including how to turn off auto‑renewal.

  • Renewals. Subscriptions renew automatically until cancelled, at the then‑current price, unless stated otherwise.
  • Refunds. Handled under the app store’s policy or applicable consumer law. Nothing here removes rights you have as a consumer.
  • Taxes. Prices may exclude taxes, which are added where required.

07   Intellectual property

The Services, including their software, design, text, graphics, logos, and the “Useful Made” and product names, are owned by us or our licensors and protected by intellectual‑property laws. These terms give you the right to use the Services, not to own them. You may not use our names or branding without our prior written permission, except as fair use or as otherwise allowed by law.

08   Your content & feedback

Anything you create with our products stays yours — we claim no ownership of your work, presets, or recordings. Where a feature needs it, you grant us only the limited permission required to operate that feature for you.

If you send us ideas, suggestions, or feedback, we may use them freely to improve the Services, without obligation or payment to you. You are responsible for making sure you have the rights to any content you provide.

09   Third‑party services

The Services rely on and link to third parties — app stores, payment processors, hosting, and external sites. Their products are governed by their own terms and policies, and we are not responsible for them. When you buy or download through an app store, that store may also be a third‑party beneficiary entitled to enforce these terms against you.

10   Disclaimers

We work hard to make the Services reliable, but to the fullest extent permitted by law they are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non‑infringement. We do not warrant that the Services will be uninterrupted, error‑free, or secure. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you, and nothing here limits rights you have as a consumer that cannot be waived.

11   Limitation of liability

To the fullest extent permitted by law, Useful Made will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us for the relevant product in the twelve months before the claim, or fifty US dollars (US$50). Nothing in these terms excludes liability that cannot be excluded by law — such as for death or personal injury caused by negligence, or for fraud.

12   Indemnity

To the extent permitted by law, you agree to indemnify and hold Useful Made harmless from claims, losses, and reasonable costs that arise out of your misuse of the Services, your breach of these terms, or your violation of any law or the rights of a third party. We may take over the defence of any such matter, and you agree to cooperate with us if we do.

13   Termination

You may stop using the Services and delete our apps at any time. We may suspend or end your access if you breach these terms, if required by law, or if we discontinue a product. When these terms end, your licence to use the Services stops, but the sections that by their nature should survive — including ownership, disclaimers, liability limits, indemnity, and governing law — continue to apply.

14   Changes & general terms

Changes to these terms

We may update these terms as our products evolve. We will change the date above and, for material changes, give clearer notice. Continuing to use the Services after an update means you accept the revised terms.

Governing law & disputes

These terms are governed by the laws of the jurisdiction in which Useful Made is established, without regard to conflict‑of‑law rules, and the courts there have jurisdiction over disputes — except where mandatory consumer law gives you the right to bring a claim in your own country. We would always rather resolve things directly, so please contact us first.

The rest

These terms, together with our Privacy Policy, are the entire agreement between you and us about the Services. If any part is found unenforceable, the rest stays in effect. Our not enforcing a term is not a waiver of it. You may not transfer your rights under these terms without our consent; we may transfer ours as part of a reorganisation or sale.
